COLLABORATIVE DIVORCE:
An Essential Primer for All Family Law Practitioners

The often bitter and costly nature of divorce proceedings has led many family law professionals to explore new avenues like Collaborative divorce for resolving dissolution cases. Started in Minnesota, collaborative divorce utilizes lawyers from both sides, as well as clients and neutral professionals, in a cooperative and joint effort to resolve differences in divorce. The process is client driven, and uses a number of negotiation and settlement techniques to achieve the best outcome for both parties. Clients and lawyers agree not to initiate any litigation while the process is underway, and there are guidelines for participation, withdrawal and any subsequent litigation.

Renee A. Rubino, Esq. will present "Divorce
without War: Mediation and Collaborative Divorce as alternatives to
Litigation at the PPSIG's September meeting. Social workers will learn ways to help their clients avoid an emotionally damaging court battle. These methods may also incorporate the use of social workers as "divorce coaches" and/or "child
specialists" to help facilitate communication. Social workers will be
part of the "team" with the attorney (or mediator, as the case may be)
and will help the family through this painful process, as well as help
them to move on and communicate as a "family," albeit in a different
forum. It's so important for parents to understand the effects of
divorce on children and the fact that both will still parent the
children after the divorce, so they really need to learn how to be civil
and communicate. Divorces through the court system can fuel the
emotions and sometimes cause more harm.
